We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We do not guarantee that our services will be uninterrupted, timely, secure, or error-free.

User Conduct

You agree to use our services only for lawful purposes and in accordance with these Terms of Use. You agree not to:

Payment and Fees

Certain features of our services require payment of fees. All fees are stated in Canadian dollars unless otherwise specified. You agree to pay all applicable fees as described on our platform at the time of purchase.

Refund Policy

Refund requests must be submitted within 14 days of purchase for courses that have not been substantially accessed or completed. We determine substantial access based on viewing more than 25 percent of course content or attending live sessions.

Refunds for group sessions must be requested at least 48 hours before the scheduled session time. Individual lesson refunds are subject to instructor availability and must be requested at least 24 hours in advance.

We reserve the right to deny refund requests that do not meet these criteria or that we determine to be fraudulent or abusive.

Cancellation and Termination

You may cancel your account at any time by contacting us at [email protected]. Upon cancellation, your right to access our services will terminate immediately, though you may retain access to previously purchased content according to the terms of your purchase.

We reserve the right to suspend or terminate your account and access to our services at any time, without notice, for conduct that we believe violates these Terms of Use, is harmful to other users, or is otherwise detrimental to our business interests.

Upon termination, all licenses and rights granted to you under these Terms of Use will immediately cease.

Live Sessions and Instructor Interaction

Live sessions are scheduled at specific times and may not be available for replay. You are responsible for attending sessions at the scheduled time. We are not liable for any inability to attend due to technical issues, time zone confusion, or other circumstances.

During live sessions and interactions with instructors, you agree to behave professionally and respectfully. We reserve the right to remove participants from live sessions who violate our code of conduct.

Recording of live sessions by participants is strictly prohibited without express written permission from Povundatel.

Third-Party Links and Services

Our services may contain links to third-party websites or services that are not owned or controlled by Povundatel. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Povundatel shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services available through such websites or services.

Disclaimers

Our services and all content are provided on an as-is and as-available basis without warranties of any kind, either express or implied. Povundatel disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, secure, or error-free, that defects will be corrected, or that our services or servers are free of viruses or other harmful components.

The educational content provided through our services is for informational purposes only. We do not guarantee any specific results from using our services. Your individual results may vary based on numerous factors beyond our control.

Limitation of Liability

To the fullest extent permitted by applicable law, Povundatel, its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or other intangible losses resulting from your access to or use of or inability to access or use our services.

In no event shall our aggregate liability exceed the amount you paid to Povundatel in the twelve months preceding the event giving rise to the liability, or one hundred Canadian dollars if no payment was made.

You agree to defend, indemnify, and hold harmless Povundatel and its affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms of Use, or your violation of any rights of another party.
